Terms and Conditions for Ecommerce Store Management & Assistance by Bix Marketing LLC dba EcomUpstart

By clicking “I agree” or “I consent” to this service or any other agreement on Ecomupstart.com, you agree to the terms and conditions of this policy and waive the right to any refund.

Introduction

These Terms and Conditions (“Agreement”) govern the relationship between you (“Client”) and Bix Marketing LLC, doing business as Ecomupstart (“Company”), regarding your use of the Ecommerce Store Management & Assistance services. By purchasing or using the service, you agree to be bound by the terms of this Agreement.

Service Description

The Company provides comprehensive Ecommerce Store Management & Assistance services tailored to enhance your online store’s functionality and aesthetic appeal. Our services include but are not limited to:

  • Store Design: Enhancing your store’s visual appeal through reorganization of sections, updating image banners, rearranging website sections, and improving user experience and navigation. Please note, this service does not include any custom coding.

  • Content Creation: Crafting compelling visual content utilizing various software tools. This includes creating still images, using downloadable images (non-licensed), and other creative content forms. Our services do not extend to recording videos or capturing original imagery.

  • Written Content Creation: Generating written content to boost your store’s appeal, including catchy headlines, engaging ad texts, concise website descriptions, and persuasive product descriptions. This service does not cover blog posts or article writing.

  • Product Research and Management: Identifying potential products available on Shopify-compatible marketplaces to add to your store. Membership costs for accessing certain marketplaces or products are the responsibility of the store owner. Our team will make every effort to fulfill product requests, but we cannot guarantee the availability of specific items. Store owners may need to source products independently if certain items are unavailable.

  • Strategic Advisors: Offering guidance and advice to optimize your store’s performance. Our advisors are not responsible for providing profit or revenue-related assistance.

  • Private Communication: Facilitating communication through dedicated Slack channels and email support at [email protected] for efficient service coordination and support.

  • Ecommerce Store Assistant: Your Ecommerce Store Assistant will be available for a reasonable number of hours daily, ranging from 4 to 8 hours depending on the workload. Each assistant can perform only one task at a time, so ample time must be allowed for each task’s completion. The Company is not responsible for any damages or financial losses incurred if tasks are not completed within a requested timeframe.

Please be aware that Ecomupstart’s services do not include marketing, advertising, or customer acquisition strategies. Our focus is on store management and assistance to help you maintain a professional and functional online store.

Payment and Fees

  • The cost for 6 months of service is $5000.
  • Payment is due in full at the time of agreement unless a payment plan is arranged.
  • Payment plans are considered a commitment to pay the full amount in agreed installments.
  • Failure to make any payment by the due date is considered a breach of this Agreement, resulting in immediate termination of services without refund.

Cancellation and Refund Policy

  • The Client may terminate the service at any time.
  • All payments made to the Company are non-refundable, regardless of the termination time.
  • Termination of the service by the Client does not waive the obligation to pay any outstanding amounts.

Payment Plan Default

  • Missing a payment under a payment plan constitutes a failure to pay, leading to the termination of service access.
  • No refunds will be issued for any payments made under the payment plan.
  • In the event of payment default, the Company reserves the right to seek legal arbitration to recover any unpaid amounts.

Service Termination

The Company reserves the right to terminate this Agreement and cease providing services at any time, for any reason, without prior notice to the Client.

Limitation of Liability

The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to this Agreement, even if informed of the possibility of such damages.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of law.

Dispute Resolution

Any disputes arising out of or related to this Agreement shall be resolved through final and binding arbitration conducted in Jacksonville, Florida, in accordance with the rules of the American Arbitration Association.

Amendment

The Company reserves the right to amend these Terms and Conditions at any time. The Client will be notified of any significant changes to the terms.

Entire Agreement

This Agreement constitutes the entire agreement between the Client and the Company regarding the subject matter hereof and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.

Acknowledgment

By purchasing or using the Company’s services, the Client acknowledges having read, understood, and agreed to be bound by these Terms and Conditions.
